The patent in question says it covers method and apparatus. I wonder why they haven't sued Jeff Han, who has been demonstrating this sort of technology for rather longer than Apple have been using it, oh wait, that's right, he hasn't got billions in the bank.
Oh by the way, you can find the patent in question here. It only covers two fingers though. My MacBook Pro recognises more that two fingers, so does that patent cover it? I've no idea about how many fingers an iPhone can recognise.
